2011 Florida Child Support Updates
Recently, the Florida legislature has made amendments to the child support statute. Major changes effective in 2011 include:
- The method of calculating child care costs has changed whereby the parent spending the majority of the time with the child no longer has to assume the first 25% of the initial costs of child care expenses
- Payor parents receive credit if they spend a "significant amount of time" with the child. The definition of "significant" decreased from 40% overnight child custody to 20% overnight child custody
Perhaps the most significant change is that child support orders must now specifically state when child support ends for each child. The new statute also requires automatic subsequent child support orders which lessen the obligor's child support in cases with multiple children amount as each child reaches the age of majority unless at such time the minor child is still in high school performing in good faith with a reasonable expectation of graduation before the age of 19.
This greatly eases the burden and costs on parents who, in the past, had to modify an existing child support orders to reflect the modification as to the child support amount.

Florida Child Support Guidelines
Child support is not something that can be waived and is a child's right. In Florida, child support amounts are determined by statute. The main factors determining child support are the combined monthly net incomes of both parents as well as the number of children. The court can also include other considerations under the statute, such as special needs or extraordinary medical, psychological, educational or dental expenses. Attorney Brown-Wiseman can assist in litigating cases where the issue of one or both parties' income is disputed. In some cases, especially if a closely-held business is owned by one of the parties, the child support lawyer will utilize the expertise of forensic accountants.
As an experienced child support lawyer Rebekah Brown-Wiseman can include important additional language into a child support order. For example, language that the obligor is no longer responsible for paying child support if the child is no longer residing with other parent. Without such language, a modification would need to be requested and may or may not be granted.
