Recent Change in Florida Adoption Law

The Law Office of Rebekah Brown-Wiseman, P.A. is up to date with changes in Florida adoption law. A 2007 change in Florida law has drastically changed the notice requirements in termination of parental rights cases. A known unmarried father in Florida previously did not need to be notified to have his parental rights terminated for the adoption of his child if he did not register with the Florida putative father registry. Due to the 2007 change in Florida law, notice or an affidavit of diligent search is now required to terminate the parental rights of a known unmarried father.

Law Office of Rebekah Brown-Wiseman PA Extra-Precautions to Protect Adoption Clients

A court reporter is not required to be present when a biological parent surrenders his or her parental rights; however, this is the regular practice of the Law Office of Rebekah Brown-Wiseman, P.A. Ms. Brown-Wiseman orally notifies the biological parent of a list of parental rights and then asks the biological parent to orally confirm that each right is understood. The court reporter transcribes the entire conversation. The transcript created in addition to the written consent greatly protects the adoptive parents from the rare case where a biological parent seeks to overturn an adoption on the grounds that they did not know their rights.
